Our services to older people are the same as they are to any client. However, there are legal rules that apply only to older people so it has become very much a legal specialism. Traditionally work with older people includes planning in the event that you may not always be able to manage independently, and you may want to appoint somebody you trust to help you. Legal Services to older people invariably includes making Wills and administering estates after death as well.
Because Turpin and Miller are a social welfare firm we offer a comprehensive service with an emphasis on securing appropriate care during your life-time and also ensuring you have not been charged for care which should be provided free of charge.
Therefore our work with older clients goes beyond planning and deals very much with the present which for some older people and their carers can be a very distressing time.
The services we provide to elderly clients are:
• Legal protection from physical, emotional or financial abuse
• Checking care home contracts and charges
• Requesting community care services
• Challenging decisions of Social Services and NHS
• Appointing some one to help with future decision-making (power of attorney)
• Applying to the court to appoint someone to make decisions (Receivership/deputyship)
• Will making service
• Estate Administration
We also have a partnership with independent financial advisers (Janet Davies and the team at Warwick Butchart Associates Limited) who specialise in older people and care home fees planning.
Jenny qualified as a Solicitor in 1996, and was previously Policy Adviser to the Law Society for Mental Health, Disability and Older People. She represented the Law Society in improving legal services to that client group; she also made a substantial contribution to the reform of Mental Health and Mental Capacity legislation.
She has been a trustee of several charitable committees, notably Rights of Women and the Legal Action Group (leader in social welfare law publications). Jenny joined Turpin & Miller Solicitors in 2005 where she is head of the Community Care department. She is also consultant to London based firm Scott-Moncrieff, Harbour, and Sinclair, along with Public Law expert Mitchell Woolf and author Luke Clements.
She has several published articles on Mental Health and Mental Capacity legislation, she is also joint editor of the BMA/Law Society “Assessment of Mental Capacity” which is the authoritative text on the legal tests for mental capacity.
She is a member of ‘Solicitors for the Elderly’.
